Instruction Daylight, sunlight and rights of light
Property New England Quarter, Brighton
As an integral part of the design team, Malcolm Hollis advised on daylight and sunlight issues for this landmark development in Brighton's New England Quarter. Known as Blocks E and F, the development will
create sustainable, high quality apartments and community space on a brownfield site to the east of Brighton's main railway station. The blocks have been carefully designed to reduce their environmental footprint, which includes special consideration of daylight and sunlight to reduce cooling loads, reliance on artificial light and to benefit from passive solar gain.
Although we were retained as daylighting and sunlighting consultants our initial survey revealed a potential rights of light issue to a nearby building which had gone unnoticed. The windows in question had been blocked up, however, the method used to infill them meant that permanent abandonment of rights of light could not be reliably demonstrated. Knowledge of the potential for a claim to be mounted enabled the client to properly assess the risks associated with rights of light.
The development was granted planning permission in 2006 and is now complete.
